Terms of Service

1. Acceptance of terms

By accessing or using GetFairways ("the Service"), operated at getfairways.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

GetFairways is operated by GetFairways ("we," "our," or "us"). These Terms govern your use of the platform, including all features, content, and services provided through the website and application.

These Terms contain a binding arbitration provision and class action waiver in Section 17A. Please read it.

2. Description of service

GetFairways is a web-based golf tournament management platform that provides tools for tournament creation, player registration, online payment collection, live scoring, leaderboards, flight pairings, RSVP, and print-ready outputs. The Service is designed for golf club administrators, league organizers, and tournament directors.

The Service includes AI-assisted features, including an in-app support assistant, described in our Privacy Policy. AI-generated responses are provided for convenience, may be inaccurate, and do not modify these Terms or create any commitment, credit, refund, or obligation on the part of GetFairways.

3. Account registration

To use certain features of GetFairways, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials and, where offered, enable two-factor authentication
• Accept responsibility for all activity under your account, including activity by co-administrators you invite
• Notify us immediately of any unauthorized access

You must be at least 18 years old to create an account.

4. Free trial, subscriptions, and automatic renewal

Free trial

GetFairways offers a 7-day free trial with full access to all features. No credit card is required to start the trial, and the trial does not convert to a paid plan automatically. At the end of the trial you will be invited to subscribe; nothing is charged unless you choose to do so. One free trial per person or organization.

Annual subscription — automatic renewal

The subscription includes unlimited tournaments, unlimited players, all features, and priority support. When you subscribe we record your affirmative consent to these renewal terms and retain that record as required by law.

Single tournament pass

The single tournament pass is $99, a one-time payment for full access to all features for one tournament. It does not renew. Access expires when the tournament is marked as complete by the administrator.

Pricing changes

We may change pricing at any time. Price changes will not affect an active subscription until its next renewal, and we will notify subscribers by email at least 30 days before a changed price takes effect.

5. Payment processing

All payments are processed by Stripe, Inc. GetFairways does not store credit card numbers, bank account details, or other payment instrument data. By making a payment, you agree to Stripe's terms of service and privacy policy.

Player entry fees

When tournament administrators collect entry fees through GetFairways, those payments go directly to the administrator's connected Stripe account. GetFairways charges no platform fee on player payments. Stripe's standard processing fees apply (approximately 2.9% + $0.30 per transaction). The administrator is the merchant of record for entry fees.

6. Cancellation, refunds, and all sales final

You may cancel your subscription at any time from your Settings page by clicking "Manage / Cancel subscription," which directs you to the Stripe billing portal. We do not require you to call, chat, or speak with anyone to cancel. Upon cancellation:

• Your access continues through the end of the current billing period
• Your tournament data remains accessible during the remaining billing period, and you may export it at any time

If you cancel during the free trial, you are not charged and nothing is owed.

All sales are final

All fees are non-refundable except where required by law. This includes the annual subscription (including cancellation before the end of a term), the single tournament pass (including if the tournament is cancelled, rescheduled, or not held), and any add-ons. This no-refund policy is disclosed before every purchase.

Player entry fees are collected by and belong to the tournament organizer. Refunds of entry fees are at the organizer's sole discretion and are processed through the organizer's Stripe account; GetFairways cannot issue them.

7. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service, including other organizers' tournaments or players' data
• Interfere with or disrupt the Service or its infrastructure
• Upload malicious code, viruses, or harmful content, including spreadsheet formulas or scripts embedded in imported files
• Scrape, crawl, or extract data from the Service by automated means
• Use the Service, including its email or SMS features, to send unsolicited communications (spam) or to contact anyone who has not registered for your event
• Attempt to manipulate, jailbreak, or extract instructions from the AI support assistant
• Resell or redistribute the Service without written permission
• Impersonate another person or entity

8. Your data and your players' data

You retain ownership of all tournament data, player data, and content you create within GetFairways. We claim no intellectual property rights over your content.

You grant GetFairways a limited license to store, process, and display your data as necessary to provide the Service. This license terminates when you delete your account, subject to the retention periods in our Privacy Policy.

As a tournament organizer you are responsible for the personal information of the players you register: you represent that you have the right to enter it, that you will use it only to run your events, and that you will honor players' requests to correct or remove their information. You can export all of your data from Settings at any time, and we will provide a copy on request within 30 days.

9. Data security and availability

We take reasonable measures to protect your data, including encryption in transit (HTTPS/TLS), Row Level Security on all database tables, and secure authentication with optional two-factor authentication. However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

We aim to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We recommend organizers keep a printed tee sheet and scorecards available on event day.

10. Third-party services

GetFairways integrates with third-party services including Stripe (payments), Supabase (database and authentication), Vercel (hosting), Cloudflare (DNS and security), Resend (email), Twilio (SMS), and an AI model provider (support assistant). Your use of these services through GetFairways is also subject to their respective terms and privacy policies. We are not responsible for the availability or conduct of third-party services.

11. Intellectual property

The GetFairways name, logo, website design, and software are the intellectual property of GetFairways. FAIRWAYLIVE is a trademark of GetFairways. You may not copy, modify, distribute, or create derivative works from any part of the Service without written permission.

12. Limitation of liability

To the maximum extent permitted by law, GetFairways shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service.

Our total liability for any claim arising from the Service shall not exceed the amount you paid to GetFairways in the 12 months preceding the claim.

The limitations in this section do not apply to (a) either party's indemnification obligations, (b) a party's gross negligence, fraud, or willful misconduct, or (c) liability that cannot be limited under applicable law. Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above may not apply to you.

13. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be error-free, uninterrupted, or free of harmful components. Golf scoring calculations, handicap computations, pairings, and leaderboard rankings are provided as tools and should be verified by the tournament administrator. GPS distances are estimates.

14. Indemnification

You agree to indemnify, defend, and hold harmless GetFairways, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, your handling of players' personal information, or your violation of any third-party rights.

15. Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in conduct that we determine, in our sole discretion, is harmful to other users, the Service, or our interests. We will make reasonable efforts to notify you before termination.

Upon termination, your right to use the Service ceases immediately. You may export your data from Settings or request an export within 30 days of termination by contacting us.

16. Changes to these terms

We may update these Terms from time to time. For material changes we will email account holders at least 15 days before the changes take effect and post the updated Terms here with a new version number and "Last updated" date. Continued use of the Service after the effective date constitutes acceptance. Changes to Section 17A (arbitration) apply only after you have been given notice and an opportunity to opt out as described there.

17. Governing law and venue

These Terms are governed by and construed in accordance with the laws of the State of Montana, United States, without regard to its conflict of law provisions.

Subject to Section 17A, any dispute not subject to arbitration shall be brought exclusively in the state or federal courts located in Cascade County, Montana, and you consent to personal jurisdiction there.

17A. Dispute resolution and arbitration

Please read this section carefully. It affects your legal rights.

Informal resolution first

Before starting arbitration, you agree to email support@getfairways.com with a description of the dispute and give us 30 days to resolve it informally. Most concerns can be resolved this way.

Binding arbitration

If we cannot resolve a dispute informally, any claim arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The Federal Arbitration Act governs this provision. The arbitrator may award the same relief a court could, on an individual basis only.

Class action waiver

You and GetFairways agree that each may bring claims only in an individual capacity, and not as a plaintiff or class member in any class, consolidated, or representative proceeding. If this waiver is found unenforceable for a particular claim, that claim will proceed in court under Section 17, not in arbitration.

Small claims

Either party may bring an individual claim in small claims court instead of arbitration.

Fees

For claims under $10,000, GetFairways will pay the arbitration filing and administrative fees. Each party bears its own attorneys' fees unless the arbitrator awards them under applicable law.

Location

Arbitration will take place by video conference or written submission unless you request an in-person hearing, in which case it will be held in Montana or in the county where you reside, at your election.

30-day opt-out

You may opt out of this arbitration provision by emailing support@getfairways.com with the subject "Arbitration Opt-Out" within 30 days of first accepting these Terms (or, for existing subscribers, within 30 days of the effective date above). Opting out does not affect any other part of these Terms.

Injunctive relief

Either party may seek injunctive relief in court to protect intellectual property or prevent unauthorized use of the Service.

18. Force majeure

GetFairways is not liable for any failure or delay caused by events beyond our reasonable control, including weather, natural disasters, power or internet outages, failures of third-party services (including Stripe, Supabase, Vercel, Cloudflare, Twilio, or Resend), or acts of government. GetFairways is not responsible for the cancellation, postponement, or conduct of any golf tournament or league; those are the organizer's responsibility.

19. General

These Terms, together with the Privacy Policy, are the entire agreement between you and GetFairways regarding the Service. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a right is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. Section headings are for convenience only.
